PUBLIC CONTRACT (OFFER)

for the purchase and sale of goods through the online store

This Contract is an official and public offer by the Seller to enter into a remote purchase and sale agreement for goods through the Website. In accordance with Articles 633, 641, and 642 of the Civil Code of Ukraine, this document constitutes a public offer. Acceptance occurs by placing an Order on the Website.

1. General Provisions

1. The sale of goods is carried out through the online website (hereinafter – the “Website”).
2. By placing an order, the Buyer confirms that they have read and agree to the terms of this Contract.
3. The Seller reserves the right to make changes to the terms of the Contract without prior notice. The current version is posted on the Website.

2. Subject of the Contract

1. The Seller undertakes to transfer ownership of the goods (women’s lingerie and related products) to the Buyer, and the Buyer undertakes to pay for and accept the goods.
2. The name, assortment, quantity, and price of the goods are determined according to the Order details.

3. Order Placement and Acceptance

1. The Order is placed independently by the Buyer via the Website interface.
2. Acceptance of the offer occurs when the Order is placed and the intention to purchase the goods is confirmed.
3. After placing the Order, the Seller confirms it by email, phone call, or other communication method.

4. Price and Payment Procedure

1. Prices listed on the Website are in UAH and include all taxes unless otherwise specified.
2. Payment is made using methods available on the Website (online payment, cash on delivery, bank card, etc.).
3. The final amount may include delivery charges if provided for by the terms and conditions.

5. Delivery and Transfer of Goods

1. Delivery is carried out within Ukraine by the carriers listed on the Website.
2. The risk of accidental loss or damage passes to the Buyer upon transfer of the goods to the carrier.
3. Delivery costs are paid by the Buyer unless otherwise specified by promotions or Website terms.

6. Rights and Obligations of the Parties

1. Seller shall: deliver goods in proper quality, quantity, and assortment; provide accurate information about the goods in accordance with the Law of Ukraine “On Consumer Rights Protection”.
2. Buyer shall: timely pay for and accept the goods; check completeness and external condition of goods upon receipt.

7. Returns and Exchanges

1. Returns and exchanges are carried out in accordance with the Law of Ukraine “On Consumer Rights Protection”.
2. Women’s lingerie of proper quality cannot be returned or exchanged according to CMU Resolution No. 172 dated 19.03.1994 (List of goods not subject to return/exchange).
3. In case of defects or poor-quality goods, the Buyer has the right to contact the Seller for resolution (exchange/refund).

8. Quality Guarantees

1. Guarantees, shelf life, and care instructions are indicated on the label, in the Website description, or accompanying documentation.
2. Violation of usage/washing rules may be grounds for refusal to satisfy claims regarding defects.

9. Liability of the Parties

1. The parties are liable for non-performance or improper performance of the Contract in accordance with current Ukrainian legislation.
2. The Seller is not responsible for the actions/inactions of delivery services; their terms and conditions are regulated by the rules of the respective carrier.

10. Confidentiality and Personal Data

1. By placing an Order, the Buyer provides personal data (full name, phone, address, etc.) used solely to execute this Contract.
2. The Seller processes personal data in accordance with Ukrainian law and the Privacy Policy posted on the Website.
3. Data transfer to third parties is allowed only as required by law or necessary to fulfill the Order (carriers, payment services).

11. Dispute Resolution

1. Disputes are resolved through negotiations. If no agreement is reached – in court in accordance with Ukrainian law at the Seller’s location, unless otherwise provided by law.

12. Final Provisions

1. The Contract comes into force upon acceptance and remains valid until all obligations are fully performed.
2. Posting this Contract on the Website constitutes an offer to an unlimited number of persons. Placing an Order confirms the Buyer’s consent to all terms.
